The website https://gavahandmade.com.ua/ (hereinafter referred to as the “Website”) is managed by the sole trader Myroslava Vasylivna Fetsych, who is registered and operates in accordance with the requirements of Ukrainian law (hereinafter referred to as the “Contractor”).
This Public Offer Agreement (hereinafter referred to as the “Agreement” or “Offer”) constitutes the Contractor’s official proposal to enter into a contract for the sale of goods presented on the Website.
In accordance with Article 633 of the Civil Code of Ukraine, this contract is a public contract, and its terms and conditions are the same for all Customers.
The fact of placing an order and/or paying for the goods confirms the Customer’s full and unconditional acceptance of the terms and conditions of this Contract.
1. DEFINITIONS
Website — the web resource https://gavahandmade.com.ua/, owned by the Contractor.
Contractor — Sole Trader Myroslava Vasylivna Fetsych.
Customer — a person who has placed an order on the Website.
User — any person using the Website.
Goods — products offered for sale on the Website.
Online Shop — the Website through which the sale of goods takes place.
2. CONDITIONS FOR ACCEPTANCE OF THE OFFER
Acceptance of this Offer is:
• placing an order on the Website;
• payment for the Goods by the Customer.
From the moment of acceptance, the Contract is deemed to have been concluded.
3. SUBJECT MATTER OF THE CONTRACT
The Contractor undertakes to transfer ownership of the Goods to the Customer, and the Customer undertakes to pay for and accept them in accordance with the terms of this Contract.
4. PROCEDURE FOR PLACING AND FULFILLING ORDERS
4.1. Orders are placed via the Website.
4.2. Order processing takes 1–3 working days.
4.3. In the case of bespoke items, the lead time may be 5 working days or more (as indicated on the product page).
4.4. Products may differ slightly from the images on the Website due to being handmade.
5. DELIVERY
5.1. Delivery is carried out by courier services within Ukraine and internationally.
5.2. Delivery costs are paid separately by the Customer, unless otherwise stated.
5.3. Delivery times depend on the chosen courier service.
6. PAYMENT
6.1. Payment is made in the amount of 100% of the cost of the goods.
6.2. Payment can be made:
• by bank transfer;
• via payment systems integrated into the Website.
6.3. Payment is deemed to have been made once the funds have been credited to the Contractor’s account.
7. RETURNS AND EXCHANGES
7.1. The Customer is entitled to return or exchange goods of satisfactory quality within 14 calendar days of receipt in accordance with Ukrainian law, provided that:
• the goods remain in saleable condition;
• there are no signs of use;
• the packaging is present.
7.2. Goods made to individual order are not eligible for return or exchange.
7.3. In the event of receiving goods of unsatisfactory quality, the Customer is entitled to a return or exchange.
7.4. The Customer shall bear the delivery costs for returns, unless otherwise agreed.
7.5. Refunds shall be processed within 14 working days of the return being approved.
8. RIGHTS AND OBLIGATIONS OF THE PARTIES
The Contractor undertakes to:
- to deliver goods of the required quality;
- ensure the protection of personal data.
The Contractor shall have the right to:
- amend the terms of the Contract without prior notice;
- engage third parties in the fulfilment of the order.
The Customer undertakes to:
- provide accurate information;
- pay for the order;
- familiarise themselves with the terms of the Agreement.
9. FORCE MAJEURE
The Parties shall be exempt from liability in the event of force majeure (war, emergencies, etc.).
10. OTHER PROVISIONS
10.1. The Agreement remains in force until all obligations have been fulfilled.
10.2. Disputes shall be resolved through negotiation or in court.
10.3. The current version of the Agreement is available on the Website.
